"We" and "You"

1. Where the terms and conditions admit: "We" and "Us" includes PM Web Design or any party acting on behalf of PM Web
Design.
"You" and "Your" includes the person purchasing the services or any party acting on the clients instructions.
2. Your agreement and business relationship with PM Web Design will be for the development of this project.
3. Your project will be coordinated by your dedicated project manager. You should insure that your project manager should be
your first point of contact and is made of aware of any communications in relation to your project.
Your project manager will be assigned at the start of the project and will help with every aspect of your project.

Content

1. If stock images are required (i.e. images that are not owned and provided by the customer), this must be made clear prior to
the deposit being paid.
In exceptional circumstances we reserve the right not to source these images. Any fees accrued for the use of these images will
be paid for by you. You will be informed prior to any commitment being made.
2. At the start of your project we will ask you how you wish to sign off your development stages, Sign offs can be made by email,
signed and posted, signed and faxed or signed and scanned
3. We maintain the right to refuse any content which we may define as offensive, abusive, indecent, defamatory, obscene,
menacing or in breach of confidence, copyright, privacy, or any other right or any other right caused by reproduction of
materials supplied by you.
4. It is your duty to establish the rights to any material supplied for inclusion on your web pages. We cannot be held responsible
for any breach of copyright or any other right caused by reproduction of materials supplied by you.
5. It is your responsibility to write all text copy for your website. If the text copy is not provided within two weeks of the start of
the relevant project stages commencement, all text areas will be populated with "dummy" text and the project will continue as
if the text had been provided. At the end of the project your final payment will still be due. We will add your text once
provided free of charge at that time.
6. All text should be provided to us in digital format, i.e., email, word document, text document, etc. Image files of text are not
acceptable. We are not liable for any mistakes in any text i.e. spelling and grammar if said mistakes exist in the original text.

The Project and Payment

1. Work will commence on your project once the agreed deposit payment has cleared into our bank account. After work has
commenced, this is non-refundable. Should you wish to cancel at any point during the process you shall remain liable for the
work that has taken place and shall be invoiced accordingly.
2. ETAs are estimated times of arrivals and are not guarantees. Your project delivery may be shorter or longer than the stated
ETA. We take all considered care to meet the ETA but cannot be held liable if the project is delayed due to 1) you delay in
passing information to us such as copy, approval of work, signing off of work etc 2) 3rd party issues and 3) Force Majeure (act
of God)
3. Once a project stage has been "signed off" all within that stage will be considered final and fully approved by you. Any further
change to work that has been signed off may require an additional quote.
4. It is you responsibility that any briefs we ask you to sign off are fully correct and complete prior to signing them. Any omissions
or errors are your responsibility and we will not be held liable.
5. We hold intellectual copyright of any material created for you until payment of the final invoice. At this time it will become
your property.
6. The final payment should reach us within 7 days of the final work being completed regardless if this is before the ETA date. If
the project has been delayed by you, the final payment is required on the final ETA date. We will of course continue to finish
the job after such payment.
7. All project stages have a built in response time from you of 72 hours within every stage of the project in which your are
required to respond. Should you not respond within 72 hours, your project is unlikely to meet its ETAs
8. We reserve the right to terminate the service to you forthwith in the event of any default of payment or for any other reason,
such termination is without prejudice to the rights of either party accrued prior to the date of termination.
9. In extreme circumstances and as a last resort, we reserve the right to remove your website if payment is not received

Web site promotion

1. Unless stated within the quote, we are not responsible for the on-going promotion of your website. The order in which
websites are ranked in the natural search results are controlled by the search engines. While we can professionally optimise
your website for this, we are unable to provide guarantees about the success of any search engine activity as we do not own
the search engine or control their "rules".
